The Washington Post was added to the complaint on August 22, 1995 after it made various unauthorized copies of these copyrighted materials and published an article on the case including quotes and paraphrased discussions of the copyrighted, unpublished materials Lerma had originally posted.

Judge Brinkema subsequently ruled that the Post could not further distribute the materials and Lerma was also forbidden to transfer the copyrighted materials or publish them.

The Post moved for a summary judgment dismissing it from the case which the Judge granted. Numerous legal experts have agreed with RTC that the Judge’s decision is erroneous and does not apply the correct law to the facts of the case.

On December 1, 1995, DGS settled with RTC.

The case against Lerma will go to trial in January 1996.
